Ex-Lokayukta condemns attack on SC lawyer

MYSORE: Former Lokayukta justice N Santosh Hedge on Thursday expressed anger against a group of men for attacking senior Supreme Court counsel Prashanth Bhushan for his comments on the Kashmir issue.
Everyone has the freedom to express their views and if the public doesn’t like their opinion they should protest in a democratic way. But it is not fair to take law into their hands, Hegde remarked.
Meanwhile, speaking to reporters after participating in an interaction with University of Mysore students on corruption in India, the former justice made it clear that his connection with social crusader Anna Hazare is only restricted to the Jan Lokpal Bill campaign.
On the Karnataka mining report, Hegde claimed as per the Act, the new Lokayukta or acting Lokayukta has to send a report to the governor if the government doesn’t act on the report submitted by the Lokayukta even after three months.
Citing examples of Andhra Pradesh and Goa, where investigations on illegal mining are underway, the former justice earlier expressed concern over the government’s attitude on this score. He said the state is yet to act on the Lokayukta report.

‘Reddy’s no mining stand will have no impact

Janardhan Reddy, a cabinet minister in the BJP government in Karnataka has decided to hang his boots as a miner. This is a very interesting decision considering the Lokayukta of Karnataka Justice N Santosh Hegde is all set to submit his explosive report on illegal mining in Karnataka.
Justice Hegde when contacted said that this decision by the minister would not have any bearing on the report. I do not know whether it is a threat to quit mining of is he trying to be good. It really does not matter as it would have absolutely no impact on my report.
Justice Hegde however refused to divulge details about the probe and said that many politicians and officials are likely to be named in his report. Earlier I was to submit the report by the end of this month, but it would be a possibility by mid April. There are many other agencies probing the same issue and we just need a bit more time to re-check facts, reverify and also corroborate them. There are plenty of issues which need to be corroborated and once this is done the report will out. This issue would mainly focus on the loss the states exchequer had incurred due to illegal mining. However I would not want to speculate the amount as of now and only the final report would give you those details, he also said.
I really cannot say what action the government of Karnataka would take on my report. My first report ran into 1600 pages and today it has gone to the waste paper basket. Let us wait and see what they will have to do about this report.
I am trying to submit the report as early as possible. I would want to be in office when the report is out. I am aware there are bound to be accusations and complaints regarding the report and hence it is very important that I am in office to react to all this, Justice Hegde further pointed out.
The earlier report of the Lokayukta had pointed out various illegalities which the state government did not act upon. It clearly stated that miners were earning Rs 5000 per tonne, but the state only got Rs 27 out of this. The report also dealt with the manner in which ore was being illegally transported and also the health hazards the people faced due to this issue. Further the report also pointed out that there was a great deal of danger to the forest cover in Karnataka due to illegal mining.

Hegde has four ideas to revive Anna movement

BANGALORE: All eyes will be on Team Anna's core committee meet on January 2-3 at Ralegan Siddhi, when the members sit down to introspect and chalk out a new road map to take their movement forward. TOI spoke to Team Anna member Justice N Santosh Hegde, who suggested four big ideas to revive a failed anti-corruption movement.
Don't lose heart
It's very important the team don't lose focus and gets demotivated by the poor response to Anna's third fast and protest. Anna should understand that the latest movement failed not because people do not want to fight corruption but they are unable to be physically present every time Anna wants to take on the government. The team should devise new plans to hold protests.
Being non-partisan
Team Anna should henceforth be careful while taking stands on political issues, especially elections. He should avoid making statements like 'don't vote for Congress' or BJP. His language should be restricted only to corruption, and he should appeal to people not to vote corrupt people, irrespective of party.
Travel across country
Team Anna should prepare a schedule to travel across the country to motivate and create awareness about Lokpal. There are still about 80% of people in the country who don't understand anything on Lokpal. He should conduct rallies to educate and motivate them so the anti-corruption movement reaches every nook and corner of the country.
Take up rural cause
Anna's movement has so far restricted itself only to middle-class India. The team should now strive to take their movement to rural India. This can happen only when they take up rural causes with a focus on corruption. Rural India is frustrated that the people there are just waiting for someone to take the initiative.

Kisan was used and abused by you, Santosh Hegde, Arvind Kejriwal, Kiran Bedi, Shashi Bhushan, Prashant Bhushan like clever manipulators in the past nine months. Let him go. I would have used more nasty language, such as let him die in peace but TOI would not let me comment in future. Let us talk. Mano-a-mano. Face to face. I have no regard for anyone, including you and your distinguished colleagues. You, perhaps, have the best interest in this project. I do too. Something, not anything must be done. Santosh Hegde was born in an ethnic Bunt[2] family to former speaker of Loksabha, Justice K. S. Hegde and his wife Meenakshi Hegde (née Adyanthaya). He is one of six children born to the couple.[3] He was born on 16 June 1940 in Nitte, Udupi district, Karnataka. He had his early education at St. Aloysius College, Mangalore and Madras Christian College in Madras. He completed his intermediate exam from St. Joseph's College, Bangalore and BSc degree from Central College of Bangalore. Hegde graduated with a law degree from Government Law College (now known as University Law College), Bangalore in 1965.[4]

After completing apprenticeship training, he enrolled as an advocate in January 1966 and was designated as senior advocate in May 1984. Hegde was appointed as the Advocate General for the state of Karnataka in February 1984 and held that position till August 1988. He worked as additional Solicitor General of the union of India from December 1989 to November 1990 and was re-appointed as the Solicitor General of India on 25-04-1998. Nitte Santosh Hegde was appointed as a judge of Supreme Court of India on 08-01-1999. He retired as judge of Supreme Court Of India in June 2005. He was conferred honorary doctorate of law degree by Mangalore University in 2005[5] For a brief period he worked as Chairperson of Telecom Dispute Settlement Appellate Tribunal, New Delhi. Hegde was of the view that Telecom Regulatory Authority of India (TRAI) was not the authority for dispute resolution between customers and telecommunication service providers.[6] He was appointed as Lokayukta of Karnataka state on 3 August 2006 for a term of five years.

[edit] Major anti-corruption cases and investigations as Lok Ayukta of Karnataka

The Lok Ayukta had exposed major irregularities in mines in Bellary, including those owned by Obulapuram Mining Company and by G. Karunakara Reddy, G. Janardhana Reddy and G. Somashekara Reddy who are ministers in the Government of Karnataka.[7] He has expressed concern about illegal mining taking place in state of Karnataka which have deep repercussion for ecology and to exchequer of state.[8] A report constituted by the Lok Ayukta uncovered major violations and systemic corruption in iron-ore mining in Bellary. There were violations in the allowed geography, encroachment of forest land, massive underpayment of state mining royalties relative to the market price of iron ore and systematic starvation of government mining entities. The damage to public interest was so serious that he recommended banning all exports of iron ore and limiting iron ore production for captive production of iron and steel[9][10]

  • He was alleged to have pressured Chief Minister of Karnataka to remove then Bruhat Bangalore Mahanagara Palike (BBMP) commissioner S. Subramanya.[11] Subramanya was heading the BBMP which was held responsible for bad maintenance of Bangalore, including drowning accidents during monsoon.[12]
  • Some people have questioned his political motives in timing his resignation a day before a BJP state government convention, though he has not been aligned with any particular political party over the course of his career.[13]

Hegde resigned from the Lokayukta position on 23 June 2010 after an honest officer (Deputy Conservator of Forests R Gokul) was suspended by order of minister J. Krishna Palemar and he felt powerless to help.[14] He expressed inability to be effective in his anti-corruption mandate owing to a non-cooperative Government of Karnataka.[15] After the resignation, he stated:
A cabinet minister wanted an officer to be suspended for having exposed attempts to export illegal iron ore from Belekeri port that was seized by our team in a raid on March 20. When the officer sought my help, I could not do anything. Besides this, all officers against whom I conducted raids and suspended, have been reinstated.[14]
Amid media speculation[16] that the ports minister Palemar had recommended Gokul's suspension on behalf of some politicians with business interests, Palemar defended his recommendation to suspend Gokul since he failed to attend a meeting, for it raised suspicions that he may be involved in the scam himself.[16] In fact, in a press meeting, Hegde indicated that:
The whole idea was if Gokul is suspended even for a day, a new investigating officer can be appointed and a scam of this stature which runs to thousands of crores can be shut. ... I couldn’t do anything for [Gokul] who had done the investigation going out of his way. I was very disturbed and couldn’t sleep for two days. I told my wife and decided to resign on Wednesday.[17]
The matter, which is being called the Belekeri port scam, relates to 3.5 million tons of illegal iron ore, belonging to the powerful mining lobby headed by G. Janardhana Reddy, that was ready to be exported from Belekeri port. After Gokul seized the ore and the high court refused to permit it's export without appropriate papers, a large part of it was surreptitiously exported from the port.[18] Hegde's resignation sought to underline the helplessness of the advisory post of the Lokayukta in such situations.[19]
After persistent protests and public pressure [20] Karnataka Chief Minister Yeddyurappa admitted to an illegal iron-ore export racket at Belekeri Port involving 35 lakh metric tonnes of iron ore.[21]
Justice Hegde withdrew his resignation and agreed to continue in the post of Lok Ayukta after persuasion from National leadership of the BJP. The party risked a major loss of face in the BJP ruled Karnataka State government by allowing an upright person in public service to leave office,[22] though All India Congress Committee general secretary B K Hariprasad said that "Hegde's actions prove that he is a BJP man".[23]

He retired as Lokayukta of Karnataka on 2 August 2011. His successor was Justice Shivraj Patil. But, barely two months after he was appointed Lokayukta of Karnataka, Justice Shivraj Patil on September 19 resigned after a controversy erupted over allotment of housing sites for him and his wife allegedly in violation of rules.
