NEW DELHI: After a wait of 43 years and an intense 11 hour-debate that lasted almost till the stroke of the midnight hour, the Lokpal and Lokayukta Bill was passed by the Lok Sabha by a voice vote after the government agreed to 10 amendments. It also secured the passage of the Whistleblowers Bill. But a legislation designed to confer constitutional status on the anti-corruption watchdog fell through, as the government failed to get two-thirds support for it-prompting finance minister Pranab Mukherjee to lament, "a sad day for India, a sad day for democracy".
At least 15 Congress members and close to a dozen belonging to UPA allies were not present at the time of voting, contributing to the defeat of the idea first proposed by Rahul Gandhi- who had termed it a "game-changer"-in August. The government needed an aye vote from 288 out of the 432 members present in the House. It could manage only 249, though there were 275 UPA members present in the Lok Sabha in the morning. The defeat led BJP leader Yashwant Sinha to demand that the government quit as it had lost moral authority. "Say bye, not aye,'' he quipped.
The government was able to get the Lokpal bill itself through thanks to its accommodative stance and the surprise decision of the BSP, SP and RJD not to participate in voting: something which brought down the effective strength of the House and eased the task of the government's managers to rustle up numbers.
The Constitution (116th Amendment) Bill, 2011 was crafted to give effect to Rahul Gandhi's proposal that the proposed ombudsman should have constitutional status. The Congress general secretary's suggestion had led Parliament's standing committee to recommend it although the issue was not on Team Anna's "wish list".
Although the absence of 26 UPA MPs was an important factor for the defeat, the government accused the opposition of seeking to weaken the fight against corruption. "We have the majority but we don't have the two-thirds majority", said Mukherjee, putting the onus of the Bill's defeat on the opposition.
Other Congress members also lost no time in raising the chorus of accusations against the opposition for denying the Lokpal constitutional status. The opposition hit back by saying that the UPA was trying to cover its own failure. "It seems certain sections in government were not happy with the proposal and they sabotaged it. Now they are trying to score propaganda points against the opposition", said CPM leader Sitaram Yechury.
BJP's Yashwant Sinha also accused the government of deliberately losing the vote in order to pin the blame on the opposition, particularly the BJP. The failure of the Constitutional Amendment Bill means that Rajya Sabha will on Wednesday debate only the Lokpal Bill and the Whistleblowers Bill. The Lokpal Bill faces a tough task in the Upper House as the UPA does not have a majority there and will find it difficult to get the legislation passed even if SP, BSP and RJD repeat their walkouts. Opposition will have more success in getting its amendments accepted in the Upper House. In a worrying development, Trinamool indicated late on Tuesday night that it was unhappy with the concession on compulsory setting up of Lokayukta. It will decide how to vote in the RS on Wednesday morning.
The amendments agreed to important concessions and helped government placate some of the restive supporters. It accepted the demand that states should not be compelled by a central law to set up Lokayuktas: a tweak which helped them to neutralize two UPA partners Trinamool Congress and DMK who had joined the Opposition in criticizing the original provision which would have made it mandatory for States to have Lokayuktas.
The attack on the Opposition was part of government's strategy to occupy the high moral ground in the fight against corruption. In the debate, Congress leaders accused Opposition of blocking the landmark because they were not sincere in fighting corruption. They said that the House should not let go of the moment to pass the landmark legislation, a far cry from the days when large sections in the government chafed at being pushed by the civil society to set up Lokpal.
Government also accepted BJP leader Sushma Swaraj's amendment to dilute the provision which required 3-4ths of Lokpal to agree on starting proceedings against Prime Minister. Now the requirement has been reduced to an agreement among two-thirds of the anti-corruption body. Section 24 which required presiding officers of legislatures to report to Lokpal action taken on reports compiled against their members has been done away with. So has been the provision which put the armed forces within Lokpal's purview.

The good signals emante of the Ombudman bill getting through In Lok Sabha. I am sure it would get through in RS with certain amendments. As lay man, it is difficult to know the nity-wity of its contents and provisions. What common people are interested to see that it keeps controlling caps on corruptions and some respite seen emerging. Lets wait and watch, how effective, is this bill.

Dear All, I've read many of these comments. I was in Central Govt. services, served in the Vigilance too, got fed up the way things go, took VR. Please do not blame the opposition. They tried their best. These nuances of how Parliament works are not easily comprehensible. The Govt. was arrogant, adamant and had shown aggressive behaviour, evident in the way S/Shri.Narayanswamy,Kapil Sibbal and Tharoor debated. Pleas from opposition to make CBI independent fell to deaf ears, which was clear when our PM spoke. I agree with Mr. Laloo in one way. This bill was brought in a hurry and somehow Pranavda wanted this to be off his back (head?). The way, none of the just and reasonable demands of the opposition/Civil Society was taken to amend, shows the intention of the Govt. What more can you expect from this dispensation?Let us wait and see what happens in RS today. When the constitutionality is challangeable in the courts of law, why make such a bill? Intentions are not clean. At least, this Govt. will not free the CBI. I find the media completely biased, specifically when they reported Shri. Kapil Sibbal's argument as "challenging the opposition" and not as a "Legal luminaire not putting forward his brain". He was talking in a street fighter style. Why we respect people with good educational and professional background? He defeated the purpose. It is unfortunate that the BJP is so opposed to democracy by denying constitutional status to the Lokpal. The passing of the Lokpal bill is definitely a victory for all of India against the manipulative politics of BJP and their mouthpiece Anna who pretends to be fighting against corruption when actually his real purpose is to defame congress. I think a structure with distributed power would be more effective in india than monopoly of a giant parliamentary system where MPs vote on basis of what their party feels and not what people in their constituencies(yet they call it democracy). Distributed structure might not be the case in other part of the world but they are not witnessing billions of dollars of corruption either. Few argue in congress that tomorrow anyone would sit on fast and would force parliament to bring-in their demands. I would like to ask to anyone of them to sit on fast and demand something and see how much crowd they can gather. People come on roads only when they are frustrated for years and want to do something about it. It is not easy to gather a huge crowd unless you have genuine reasons. Those who still not convinced that a strong lokpal bill would make much difference think about a scarecrow in fields to protect crops from birds, it doesn't do anything but solves the purpose of it. Time to think what other options do we have(yes we have to change ourselves to bring this revolution, emotional young generation can do it but sorry it doesn't work for many of 50 plus indifferent parliamentarians who have been seeing for decades.)

How ever, congress should have done their homework as this move when they did not have enough numbers is waste of tax payers money. Sen. Joe Lieberman, an independent who caucuses with the Democrats, made his own trip to the White House on Wednesday, when Obama signed legislation overturning Don't Ask, Don't Tell, the military's ban on gays serving openly in the armed forces.
Courtney helped champion the Student Aid and Fiscal Responsibility Act, which dramatically increased the federal investment in annual Pell Grant scholarships and revamped the federal loan programs by cutting subsidies to private banks and making students loans cheaper.
"If you look at a state like Connecticut, enrollment in higher education has shattered all records," Courtney said. "And I believe very strongly that the boost to Pell grants, combined with the reduction in [the cost of federal] student loans, has really fueled this spike in enrollment."
Rep. Rosa DeLauro, D-3rd District, helped eke out 11th-hour victories in this Congress on a sweeping food safety bill and a major child nutrition bill.
This session, DeLauro said, is remarkable not just for the number of bills passed, but for the breadth of those measures.
The health care bill is remaking one of the biggest sectors of the American economy. The Wall Street reform measure will bring sweeping changes to the financial services industry. And the various stimulus measures passed in this Congress pumped more than $1.6 trillion into the U.S. economy.
"These are big blockbusters," DeLauro said.
Still, there were some significant omissions and failures. Congress stumbled in carrying out its most basic duty: approving a budget and spending bills to keep the government running.
Instead, in the closing hours of the lame-duck session, lawmakers passed a short-term funding bill that will keep federal spending essentially flat, at 2010 levels, until March 4.
That punts key spending decisions to the next Congress, when Republicans will control the House and have a stronger hand in the Senate. And in the meantime, it creates uncertainly at the state and local level, in Connecticut and elsewhere, about what to expect from Washington.
"There's a lot of programs in defense and non-defense that are going to be in a holding pattern," said Courtney.
During a recent meeting about a brownfield site in his district, Courtney recalled, the Environmental Protection Agency's top official for New England said the agency could take little action until they got clearer funding signals from Congress.  "It kind of immobilizes them," Courtney said of short-term funding bill.
Lieberman said the biggest disappointment was the stalemate over climate change legislation. And at least for now, he said, the moment is passed for a broad bill tackling greenhouse emissions.
"The problems of climate change and energy dependence get worse every day, but the reality is the composition of Congress has changed," Lieberman said. "Nothing as comprehensive as the American Power Act... has any chance in the next two years, so we've got to go back and clear the table."
He said a slimmed down energy measure, along with deficit reduction and cyber-security measures, would be his top priorities in the next Congress.
Lieberman also said that, in the wake of his work on DADT repeal, he would make a more aggressive push to pass legislation banning discrimination based on sexual orientation in employment and providing domestic partner benefits to gay and lesbian federal employees.
But he and others acknowledged that there's a significant degree of uncertainty about how the 112th Congress will unfold. With Republicans in control of the House and gaining seats in the Senate, it's unclear if the blitz of bipartisanship seen in recent days will spill over into the next Congress, or evaporate as the 2012 presidential election heats up.
Courtney said his priorities for the next Congress would be pushing an overhaul of the No Child Left Behind education law and pressing Congress to preserve its commitment to fund two Virginia-class submarines in 2011.
But on other issues, he expects to be on the defensive, whether it's protecting health reform or shielding the student aid bill. And he's worried he might lose his seat on the House Education and Labor Committee, as newly empowered House Republicans move to slim down that panel and others.
DeLauro said she anticipates political fireworks next year over federal spending.
"The battle ground will be in the appropriations bills," said DeLauro, who chairs a key House Appropriations subcommittee. She said GOP plans to slash domestic spending "will create real problems for the states" and could lead to higher unemployment and more economic turmoil.
"Depending on what the cuts are, Democrats will fight back," she vowed.
Dodd, for his part, seemed relieved not to be gearing up for another round. But with the crush of lame-duck legislation, he said he hadn't had time to figure out what he'll do next.
"It's a little like groundhog day around here," he quipped. "It never seems to end."
